In examining the doctrine of informed consent in the context of pathology practice, it is useful to begin by examining the conceptual underpinnings of the doctrine generally. Why must a physician obtain informed consent from a patient? Is informed consent a statutory obligation imposed by a legislature? Is it an ethical obligation flowing from the fiduciary relationship between physician and patient? Or, is it something even more fundamental?
