India is a party to the United Nations Convention on Biological Diversity signed at Rio de Janeiro on the 5th day of June, 1992; the said Convention has the main objective of conservation of biological diversity, sustainable use of its components and fair and equitable sharing of the benefits arising out of utilization of genetic resources. Under Section 2(b) of the Biological Diversity Act deals with biological diversity. It means the variability among living organisms from all sources and the ecological complexes of which they are part, and includes diversity within species or between species and of eco-systems. Intellectual Property Rights is a right of the creator etc., It gives monopoly rights for particular period of time. In this paper an attempt has been made to bring out the importance of protection of biological diversity under the biological diversity Act, 2002 in the context of intellectual property rights.
